Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) These two appeals arise out of a common order dated 08.02.2005 in I.T.A.Nos.72/V/2000 and 73/V/2000 on the file of the Income Tax Appellate Tribunal, Visakhapatnam (in short 'the Tribunal').

At the hearing, Mr.Y.Ratnakar, learned counsel for the appellant-assessee in both these appeals, submitted that after filing of these appeals, his client has moved applications for recalling the impugned orders and that the Tribunal has accordingly recalled and passed fresh orders in favour of the appellant vide common order dated 12.03.2008. The learned counsel submitted that in view of this subsequent event, the cause in the present appeals does not survive for adjudication and that, therefore, the appellant is not interested in pursuing these appeals.
