HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL PETITION No.13839 of 2013 ORDER :

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner/A.3 seeking to quash the proceedings in Crime No.328/2013 of II Town Police Station, Karimnagar District, registered against him and others for the offences punishable under Sections 3, 4 and 5 of Immoral Traffic Act. Heard learned counsel for the petitioner/A.3 and the learned Additional Public Prosecutor appearing for the respondent-State.

The learned Additional Public Prosecutor submits that after filing the Criminal Petition, interim stay was granted by this Court on 22.11.2013, whereas investigation has been completed in the above crime and charge sheet has been filed on 29.10.2013 i.e., even prior to granting of stay, therefore, the cause in this criminal petition does not survive for adjudication.

In view of the said submission, this Criminal Petition is dismissed as infructuous. Interim stay granted by this Court on 22.11.2013 shall stand vacated.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
