THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37304 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in registering the Crime No.102 of 2016, as illegal and arbitrary. Heard and perused the material available on record. The main grievance of the petitioners is that on 27.09.2016, the 2nd respondent police while performing patrolling duty in Tekula Thanda Village, on reliable information, caught one Sri Lakavath Veeranna while he was in illegal possession of illicit distilled liquor and seized 4 1⁄2 litres of I.D. liquor, 25 kgs of black jaggery and 10 kgs of alum and the 2nd respondent has registered the case as Crime No.102 of 2016 for the offences under Sections 7(a) read with 8(e) of the A.P. Prohibition Act and Sections 3 & 4 of the A.P. Excise Act and that basing on the confession statements, the 2nd respondent has included the names of the petitioners as A-4 to A-6 in the above said crime.
Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.102 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 2nd November, 2016 KL
