AMARNATH GOUD I.A.No.1 of 2018 in/and F.C.A.No.345 of 2017 COMMON ORDER:- (Per Hon'ble Sri Justice Suresh Kumar Kait) The present appeal is filed challenging the order and decree dated 11.08.2017 in FCOP.No.6 of 2016 passed by the Judge, Family Court-cum-III Additional District Judge, Vizianagaram, whereby the petition filed by the respondentwife under Section 13 (1) (ia) & (ib) of Hindu Marriage Act, 1955, for dissolving the marriage between her and the appellant-husband solemnized on 08.05.2009, was allowed. During pendency of the appeal, the present application i.e., I.A.No.1 of 2018 is filed stating that the parties have decided to re-unite and lead marital life and, therefore, prayed to allow the appeal by declaring the decree dated 11.08.2017 passed in FCOP.No.6 of 2016 as null and void in terms of the compromise entered into between them before the Lok Adalat on 08.09.2018.
Today, the appellant and the respondent are personally present in Court with their respective counsel. In proof of their identity, they have produced the photostat copies of their Aadhaar Cards issued by the Government of India.
On being asked, the parties stated that the matter has been compromised and they have decided to live together with their minor child and lead marital life. Since the parties have decided to live together and lead marital life, we hereby set aside the order and decree dated 11.08.2017 passed in the above mentioned FCOP. Accordingly, I.A.No.1 of 2018 and FCA.No.345 of 2017 are allowed in terms of the compromise entered into between the parties before the Lok Adalat on 08.09.2018. The award passed by the Lok Adalat on 08.09.2018 shall form part of the record.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
