THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.26120 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare that the action of the respondents 3 & 4 in directing the petitioner to attend the police station everyday and harassing her in a civil dispute between the petitioner and the 5th respondent herein with regard to the property admeasuring Ac.2.40 cts in D.No.89/1 situated at Telukutla Village, Gurazala Mandal, Guntur District as bad, illegal, arbitrary, violative of Articles 19 & 21 of the Constitution of India and consequently direct the respondents not to interfere with the civil dispute between petitioner and 5th respondent."
Heard Sri V.S.K. Rama Rao, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.
Today, when the matter is called, written instructions, dated 25-08-2015 furnished by the Sub-Inspector of Police, Gurazala Police Station, Guntur District have been placed on record by the learned Government Pleader for Home and the said instructions read as under:
"In this regard, I submit that on 12.06.15 one Sri Kurapati Venkateswarlu s/o Mukandaiah, 57 yrs, C/Kamma, Telukutal village now residing at Piduguralla town came to Gurazala Police station and presented a report stating that he has Ac.2.40 cents agricultural land in S.No. 89/1 of Telukutla village. One Smt. Manam Venkamma w/o.venkaiah and her relatives trying to grab the land. So he filed a suit in the Hon'ble Prl. Junior Civil Judge Court, Gurazala vide O.S. No.49/14 and also filed petition for injunction order vide I.A. No. 155/2014 on the file of the above court. The Hon'ble court
dismissed the petition file for the injunction order. Later, he approached the Hon'ble Xth Addl. Session District Judge Court, Gurazala and his petition was taken file vide CM.A. No. 13/2014 and also granted temporary injunction order. On 12.06.15 while he went to his field one Maram Venkamma, her daughter, her son-inlaw objected him to entering into his fields and also abused him with filthy language and also threatened him with dire consequences by contempt pf Court Order. He has life threat from them hence requested to take action against them. On receipt of the report of Kurapati Venkateswarulu I entered the same 4ft reception register in Serial No.151/2015 o Gurazala Police Station and informed the petitioner Maram Venkamma and others for enquiry, but the petitioner and others did not turn up to the police station. Later, I advised the respondent Kurapati Venkateswarulu to approach the Hon'le Court for necessary directions.
Further I submit that the SHO Gurazala P.S. never harassed the petitioner to attend the police station for enquiry of the above subject. This for favour of information." On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition. In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 25-08-2015 furnished by the Sub-Inspector of Police, Gurazala Police Station, Guntur District.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
