HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3379 OF 2017 ORDER:

The case of the petitioner is that he was issued notice under Section 7 of the A.P.Land Encroachment Act, 1905 (for short 'the Act') on 27.12.2016 vide proceedings No.A/617/2016, asking the petitioner to show cause as to why he should not be charged a penalty for occupation in addition to the full assessment on the land in his occupation under Section 5 of the Act or evict from the land in an extent of Ac.240 sq.yards in Sy.Nos.455 to 458, Kukatpally, Hyderabad. In pursuant to the said notice, the petitioner gave reply on 05.01.2017. But the respondents without considering the same are trying to evict the petitioner. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the 3rd respondent is directed to pass final orders in pursuant to the notice issued to the petitioner on 27.12.2016. Till such time, status-quo obtaining as on today shall be maintained in respect of the subject property.

With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
