THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.8548 of 2017 ORDER:

This Writ Petition is filed challenging registration of Crime No.11 of 2017 on 15.01.2017 for the offences punishable under Sections 376 IPC read with Sections 3(A) and 4 of the POCSO Act, 2012, by the third respondent.

Along with the Writ Petition the petitioner as well as respondent Nos.5 and 6 filed affidavits stating that due to some personal disputes they filed the complaint, but after the complaint, the engagement ceremony of the petitioner's son with the sixth respondent was performed on 24.02.2017 and marriage is likely to take place within a short time. The petitioner as well as respondent Nos.5 and 6 are present in my chambers today when the matter is taken up and they stated that the above facts are correct. The complainant - fifth respondent, stated that she is not interested in pursuing the complaint.

Since the crime was registered pursuant to the complaint lodged by the fifth respondent on 15.01.2017, liberty is given to the petitioner as well as to respondent Nos.5 and 6 to appear before the concerned Station House Officer - third respondent, and he is directed to record their statements and take further necessary action before the concerned Magistrate in view of the stand taken by the parties.

The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 16.03.2017 Note: Issue C.C tomorrow.
