THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.8031 of 2003 ORDER:

This writ petition is filed seeking the following relief: " .. to issue a writ or order or direction more particularly one in the nature writ of Mandamus declaring the selection of the 2nd respondent to the post of Sub-Engineer in the office of the 1st respondent as illegal, arbitrary and unconstitutional and violation of Art.14, 16 of the Constitution of India and consequently direct the 1st respondent to consider the case of the petitioner for the same post and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.

When the matter is taken up for hearing, Sri R.Vinod Reddy, learned standing counsel appearing for the respondentCorporation had contended that the petitioner is challenging the appointment of the 2nd respondent on the ground that the post of Sub-Engineer has to be filled up on the basis of district. Learned standing counsel further contended that the case of the petitioner was considered and rejected as he did not come up on merit. In view of the submissions made by the learned standing counsel, this Court feels that there are no merits in the writ petition. Accordingly, the Writ Petition is dismissed. No order as to costs.
