THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7989 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue writ or direction particularly in the nature of writ of Mandamus or any other appropriate writ, A). To declare the action of the 4th respondent, in not including the agenda proposed by the writ petitioners as well other member societies pursuant the requisition dated 5th January, 2017 in the general body meeting scheduled to be held on 17th March, 2017, as illegal, void, arbitrary and thereby violating the provisions of the act as well bye-laws of the 4th respondent bank.

B). Consequently, to direct the 4th respondent to include and discuss the agenda proposed by the writ petitioners as well other member societies through the requisition dated 5th January, 2017, in the general body meeting scheduled to be held on 17th March, 2017."

Heard Sri V.R.Avula, learned counsel for the petitioners, learned Government Pleader for Cooperation for respondents 1 to 3 and Smt.Bobba Vijayalakshmi, learned standing counsel for the 4th respondent.

When the matter is called, it is represented by the learned counsel for the petitioners that for redressal of the grievance of the petitioners herein, petitioners herein

AVSS,J W.P.No.7989 of 2017 submitted a representation dated 09.02.2017, before the 2nd respondent - The Special Commissioner for Cooperation and Registrar of Cooperative Societies and no action has been taken on the said representation and a request is made by the learned counsel for the petitioners to direct the 2nd respondent to take appropriate action in accordance with law on the said representation.

Recording the said submission, this writ petition is disposed of, without expressing any opinion on the merits and demerits of the matter, directing the 2nd respondent to pass appropriate orders on the representation dated 09.02.2017, said to have been submitted by the petitioners herein, in accordance with law, within a period of two weeks from the date of receipt of a copy of this order. 5.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
