THE HON'BLE SRI JUSTICE PRAVEEN KUMAR WRIT PETITION No. 17955 of 2016 ORDER:

The present Writ Petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in not considering the appointment of the petitioner to the vacant post of Sadar Kazi, Godhal, Balmoor Mandal, Mahaboobnagar District, Telangana State, as illegal and arbitrary.

A perusal of the material on record would show that on 24.10.2014, the Government of Telangana, represented by its Secretary, issued a memo stating as under:

"A copy of the reference cited together with its enclosures is sent herewith to the Collector and District Magistrate, Mahaboobnagar. He is requested to examine the matter as per Section 2 of the Kazis Act, 1880 and furnish his specific remarks/recommendations in the check list enclosed together with the required documents to Government, immediately".

It is stated that inspite of the said memo dated 24.10.2014 and the second memo dated 27.02.2016, calling upon the Collector to examine the matter as per Section 2 of the Kazis Act, till date the same is kept pending and the appointment of the petitioner to the post of Kazi is being delayed for no reason.

Having regard to the said facts and circumstances, the Writ Petition is disposed of directing the first respondent to take immediate steps and pass orders, in accordance with law, as early as possible.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _____________________
