HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Civil Revision Petition No. 1421 of 2016 Order:

The petitioner herein is the plaintiff in OS No.7 of 2012 on the file of the Junior Civil Judge, Wanaparthy, which was filed for grant of perpetual injunction in respect of the agricultural land to an extent of Ac.0-20 gts., in Survey No.1215 of Wanaparthy Town and Mandal, Mahaboobnagar District. The petitioner herein filed IA No.22 of 2012 in OS No.7 of 2012 seeking temporary injunction, but the said application was dismissed by the trial Court on the ground that the petitioner failed to establish his prima facie case and balance of convenience, by an order dated 18.02.2013. Against the said order, the petitioner preferred CMA No.7 of 2013 before the Additional District Judge, Wanaparthy, who confirmed the same, by an order dated 12.07.2013. Challenging the said order of the Additional District Judge, Wanaparthy, the present Civil Revision Petition is filed.

2. It is clear from the above sequence of events that the plaintiff is not having any injunction since 2012. Since the suit itself is for permanent injunction, this Court is not inclined to go into the merits of the case at this length of time, but directs the trial Court to expedite the disposal of the suit. The trial Court shall endeavour for disposal of the suit in OS No.7 of 2012 on or before 31.12.2016.

3. With the above observation, the Civil Revision Petition is dismissed. However, in the circumstances, no costs.

4. As a sequel thereto, the miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
