This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.2, in Crime No.38 of 2017 on the file of the Station House Officer, G. Madugula Police Station, Visakhapatnam District.

The offences alleged are under Sections 8(c) R/w.20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the Act').

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 4.

The facts of the case are that the commercial quantity of ganza was seized from this petitioner. Hence, Section 37 of the Act comes in the way of granting bail to the petitioner. Petitioner's counsel, except contending that the petitioner has been in jail since 21.08.2017, does not make any submission, which would entitle him for bail, by overcoming the hurdles of Section 37 of the Act. Hence, the Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
