HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRIT PETITION No. 1076 OF 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus to declare the action of the respondents and their men representing through them in trying to interfere and dispossess the petitioner from his land admeasuring 400 square yards situated in Sy.No.157, plot bearing No.3 Part, Ward No.4, Block No.8 of Bagh Hayathnagar Village, Hayathnagar Revenue Mandal, Ranga Reddy District, as arbitrary, illegal and violative of principles of natural justice.

2) By an order, dated 05.01.2018, this Court while admitting the writ petition, granted status quo. 3) A counter came to be filed by the respondents, stating that the land which was allotted to them is in Sy.No.159, where as the petitioner is claiming his land in Sy.No.157, which is in a different survey number. Hence, stated that there is no necessity to the respondents to issue any notice to the petitioner, as the respondents did not enter into the land of the writ petitioner.

4) In view of the above, it can be said that there was no interference by the respondents in the land of the petitioner

and no effort was made by them to dispossess the petitioner from his land. However, if any action is sought to be initiated insofar as the land is concerned, the same shall be only in accordance with law.

5) Accordingly, the writ petition is disposed of. 6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
