HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.15402 of 2006 ORDER:

This Writ petition, under Article 226 of the Constitution of India, is filed by the petitioners to declare the action of the respondents in issuing the Addendum to the notification published in the A.P. Gazette No.35, dated 01.09.2005 under Section 5 (1) of the Wakf Act, 1995 declaring the survey No.19 to the extent of Acs.59.90 cents is Wakf Property and consequential proceedings of the 2nd respondent in Rc.No.E8/ 1544/ 2003, dated 12.06.2006, as illegal and arbitrary. When the matter is taken up for hearing today, none appears on behalf of the petitioners. On the earlier occasion i.e. on 11.07.2017 also none appeared on behalf of the petitioners.

After perusing the material available on record, this Court is of the view that petitioners can approach the Wakf Tribunal for the relief sought before this Court and hence, the writ petition is disposed of with the following direction:

" The petitioners are directed to approach the Wakf Tribunal to seek their remedy."

No order as to costs. Miscellaneous petitions pending if any, shall stand closed.
