THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23579 OF 2009 O R D E R :

When the matter is taken up for hearing, learned Government Pleader appearing for the respondents contends that the petitioner in the present writ petition has challenged the Election notification dated 22.10.2009 and due to efflux of time, the tenure of the elected body has come to an end. Therefore, the cause in the writ petition no longer survives for adjudication and has become infructuous. Recording the above said submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed in consequence.
