THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1153 of 2019 O R D E R:

Petitioner asserts that she is a Fair Price Shop Dealer with respect to Shop No.2281011 of Zaheerapura, Khammam Town. Her grievance is that respondent Nos.2 and 3 are not supplying the essential commodities for distribution though her licence was neither suspended nor cancelled and only a notice was issued as on date.

Learned Government Pleader for Civil Supplies appearing for the respondents, on instructions, submits that the show cause notice came to be issued on 24.01.2019 for enquiry and the petitioner is yet to submit her explanation.

In view of the above and as the licence of the petitioner is neither cancelled nor suspended as on date, without expressing any opinion on the merits of the matter, the writ petition is allowed with the direction to the respondents to supply essential commodities to the petitioner for distribution.

However, proceedings under 6-A of the Essential Commodities Act may go on in accordance with law.
