THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1051 of 2019 O R D E R:
The sum and substance of the grievance of the petitioner in this writ petition is that respondent Nos.2 and 3 are taking steps to grant permission to respondent No.4 for construction of flats in the subject lands. He asserts that there are civil disputes between him and respondent No.4 and O.S.No.70 of 2013 filed with regard to the same in the Court of Principal District Judge, Khammam, is pending. Learned Standing Counsel for respondent No.3-Khammam Municipal Corporation submits that as on date, respondent No.4 had not made any application seeking permission for construction of flats in the subject lands, as such, the writ petition is misconceived and premature. She also submits that the petitioner may approach respondent No.3 with a request to put him on notice as and when respondent No.4 files an application and dispose of the same in accordance with law.
In the light of the above submission, the writ petition is disposed of giving liberty to the petitioner to approach respondent No.3 with a request to put him on notice, if respondent No.4 makes any application for construction of the flats in the subject lands. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:23.01.2019 kdl
