Heard learned counsel for petitioner, the Assistant Government Pleader for respondent No.2 and Mr. G. Seshadri for respondent No.3. Notice to respondent No.4 is dispensed with having regard to the order the Court is proposing to pass in the instant writ petition. 2.

Petitioner prays for Mandamus declaring the action of respondents 1 to 3 in not taking suitable action against the fourth respondent in raising illegal structures at D.No.11-162/ A, Muthunagar, Tiruchanur Village, Tirupati Rural Mandal as illegal and amounts to refusing to exercise the jurisdiction conferred on the third respondent. 3.

Mr. G. Seshadri, on instructions, submits that the construction activity of the fourth respondent is stopped. The Gram Panchayat will not permit the fourth respondent to undertake the construction without permission from the gram panchayat in this behalf. He further submits that the gram panchayat is prepared to hear the petitioner as well as the fourth respondent and take a decision on the pending application of the petitioner.

The statement is placed on record. The writ petition is disposed of accordingly. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs. ____________ S. V. BHATT, J December 23, 2016 DSK
