HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 14144 of 2003 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner was appointed on compassionate grounds in the category of Helper, but the respondents were not extending the pay scale attached to that post. He contends that appropriate orders may be passed directing the respondents to extend the pay scale of Helper to the petitioner.

Learned standing counsel for the respondents contends that since there were no vacancies of Helper, the case of the petitioner was considered and he was appointed as Cleaner in the year 1997 and the petitioner has filed the present writ petition in 2003 after lapse of six years and therefore the writ petition is liable to be dismissed only on the ground of delay and laches.

This Court having considered the rival submissions made by the parties is of the considered view that the writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order and upon receiving such representation, the respondents shall consider the same and pass appropriate orders, in accordance with law, within four weeks thereafter.

With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs. ______________________________ ABHINAND KUMAR SHAVILI, J 15th December, 2018 cbs
