THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.306 OF 2018 ORDER:

This petition is filed by the petitioners-A1 to A4 under Section 482 Cr.P.C. to quash the proceedings in C.C.No.318 of 2015 on the file of the Chief Metropolitan Magistrate, Hyderabad, which took cognizance of the offences punishable under Sections 324, 506 and 354 r/w 34 IPC. 2.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioners would submit that there are material contradictions in the statements given by the witnesses.

Having argued for sometime, learned counsel for the petitioners submits that the personal attendance of the petitioners may be dispensed with before the Court below. 5.

As seen from the F.I.R. and the charge sheet laid in this case, there are specific allegations constituting the offences referred supra. There are specific overt-acts against the petitioners. It cannot be held that continuation of proceedings against the petitioners before the Court below would be an abuse of process of law. Therefore, there are no grounds to quash the proceedings.

Insofar as the dispensing with the personal attendance of the petitioners is concerned, the petitioners are at liberty to file an application as and when they choose to do so depending upon the circumstances.

With the above observation, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
