CHANDRAIAH) The appellant-husband preferred the present Appeal aggrieved by the judgment and decree dated 19.02.2014 passed in HMOP.No.120 of 2011 wherein and whereby the learned Senior Civil Judge, Khammam allowed the aforesaid HMOP filed by the respondent-wife seeking restitution of conjugal rights.

Today, when the present appeal is taken up for hearing, the learned Counsel for the appellant-husband seeks permission to

withdraw the appeal.

Permission is accorded and the Civil Miscellaneous Appeal is dismissed as withdrawn.

Miscellaneous petitions pending consideration if any in the Civil Miscellaneous Appeal shall stand closed in consequence. No order as to costs.
