THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.26306 OF 2009 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the respondents herein in marking 15 meters of frontage of residential houses of the petitioners in the last week of November 2009 for the purpose of construction of a new drainage canal on either side of Athota Village, Kollipara Mandal, Guntur District without notice nor acquiring the said 15 meters either under Land Acquisition Act or any other law as being illegal, unjust arbitrary and violative of Articles 14 and 21 of the Constitution of India, and be pleased to pass such other order or orders."

The matter pertains to the year 2009. This Court has already passed an interim order on 03.12.2009 directing the respondents not to demolish 15 meters of frontage of the petitioners' houses without following the due process of law. Further, learned Government Pleader for Roads and Buildings also informed that the construction of the new drainage canal was completed. Therefore, this Court is of the view that nothing survives for adjudication in this writ petition and hence, no further orders are required to be passed in this Writ Petition. 3.

Accordingly, the Writ Petition is disposed of as infructuous. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
