THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.1089 of 2018 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners, assailing the action of the respondents 1 to 4 in interfering with the construction activity of the petitioners in the Plot bearing Nos.792/2 and 792/5, in Category-II of Miyapur Residential Complex, total admeasuring 615.7 square yards equivalent to 514.80 square meters, in Survey Nos.20 and 28/1, situated at Miyapur Village, Greater Hyderabad Municipal Corporation (GHMC), Serilingampally Circle, Serilingampally Mandal, Ranga Reddy District, without following the procedure established by law.

I have heard the submissions of Sri C.Tulasi Krishna, learned counsel appearing for the petitioners, the learned Government Pleader for Municipal Administration and Urban Development appearing for the 1st respondent, and of Sri Sampath Prabhakar Reddy, learned Standing Counsel for GHMC, representing the respondents 2 to 4. I have perused the material record. 3.
Learned counsel for the petitioners submits that the constructions are made as per building permit without any deviations and that on the complaint of the 5th respondent, interference is being sought to be made with the constructions being validly made.

Learned Standing Counsel appearing for the respondents 2 to 4 would submit that since deviations are noticed on inspection, the
MSRM, J W.P.No.1089 of 2018 Corporation is taking steps for proceeding in accordance with procedure established by law.

Learned counsel for the petitioners asserts that there are no deviations.

Recording the submissions, the Writ Petition is disposed of directing the respondents 1 to 4 not to interfere with the construction activity being undertaken, in the subject property of the petitioners, in strict accordance with building permit. However, in case of any deviations from the building permit, the respondents 1 to 4 are at liberty to take appropriate action against such deviations and violations of building permit, in strict accordance with procedure established by law.
