THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.411 OF 2019 ORDER:

This Criminal Petition, under Section 439 (1) (b) read with 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), is filed seeking to relax the condition imposed vide order, dated 30.11.2018, in Crl.M.P.No.1160 of 2018 in Crime No.176 of 2018 of P.S. Maddur, on the file of Special Sessions Judge - cum - VII Additional District and Sessions Judge, Mahabubnagar, with regard to attendance of the petitioner/accused before the Station House Officer, Maddur Police Station, between 10:00 AM and 12:00 Noon on every alternative day from the date of release till filing of final report by the police or 90 days, whichever is earlier. 2.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor representing the respondent/State and perused the record.

In the course of submissions, it is brought to the notice of this Court that the petitioner/accused is serving in Armed Forces. Under these circumstances, the condition imposed with regard to his attendance before the Station House Officer, Maddur Police Station, is modified as follows:

"The petitioner/accused is directed to attend before the Station House Officer, Maddur Police Station, on every Second Saturday between 10:00 AM and 11:00 AM till filing of the charge sheet".

The other conditions imposed by the Court below shall remain unaltered.

With the above modification, the Criminal Petition is ordered. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
