THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.363 of 2019 ORDER:

This petition, under Section 439 (1) (b) read with 482 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/accused seeking to relax the condition imposed by the Court of Special Sessions Judge-cum-VII Additional Sessions Judge, Mahabubnagar, vide order, dated 18.12.2018, in Crl.M.P.No.1236 of 2018 in Crime No.71 of 2018, whereunder the petitioner/accused was directed to attend before the Station House Officer, Maddur Police Station between 10:00 AM and 12:00 Noon on every alternative day from the date of release till filing of final report by the police or 90 days, whichever is earlier. 2.

Heard learned counsel for the petitioner/accused, learned Additional Public Prosecutor appearing for the respondent-State and perused the record.

It is brought to the notice of this Court that the petitioner/accused is serving in Army.

Under these circumstances, the condition with regard to attendance before the Station House Officer, Maddur Police Station is modified as follows: "The petitioner/accused is directed to attend before the Station House Officer, Maddur Police Station on every Second Saturday between 10:00 AM and 12:00 Noon till filing of the charge sheet".

The other conditions imposed by the Court below shall remain unaltered.

With the above modification, the Criminal Petition is ordered. Miscellaneous Petitions, if any, pending in this petition shall stand closed.
