THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34205 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of Shop No.42, Basampalli Village of Hindupur Mandal in Anantapur District. On the basis of the report submitted by the Tahsildar, dated 18.03.2015, a show cause notice was issued to the petitioner on 18.03.2015. The petitioner submitted his explanation on 27.03.2015. After receipt of the explanation, the authorization of the petitioner was cancelled by the third respondent on 08.04.2015. Against the said order, the petitioner preferred an appeal before the second respondent, which was dismissed on 23.09.2015. Challenging the same, the present Writ Petition is filed. In view of the alternative remedy of revision before the District Collector, this Court is not inclined to entertain the Writ Petition.
In the circumstances, giving liberty to the petitioner to file a revision before the District Collector, the Writ Petition is disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 14.10.2015 vs
