THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.16999 OF 2016 ORDER:
This Writ Petition is filed on the apprehension that the petitioner's property in question would be demolished for construction of drainage system.
Learned Government Pleader for Panchayat Raj appearing for respondents 1 and 2 and Sri Ch. Ravi, learned Standing Counsel appearing for respondent No.3, would submit that any action that is proposed to be taken by the respondents would be in accordance with law.
In view of the said submission and as the Writ Petition itself is filed on a mere apprehension, since there is no material as on today except the alleged marking made by the authorities concerned, this Court is not inclined to entertain the Writ Petition. However, it is made clear that the property rights of the petitioner shall not be interfered with without following due process law and in any event, if any portion of the land or property of the petitioner is required for any public purpose, the same shall be acquired after paying due compensation as required under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
Subject to the above observations, the Writ Petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending in the Writ Petition
shall stand closed.
