HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.27654 of 2007 ORDER:

This writ petition is filed for a writ of mandamus declaring the action of the respondents in not regularizing the petitioner service, not paying the equal pay for equal work on par with Grade-II driver as arbitrary, unjust and in violation of Articles 14, 16 & 21 of the Constitution of India and consequently to direct the respondents' corporation to regularize the petitioner service from the date of initial appointment along with all consequential benefits.

Heard and perused the material available on record. 3.

On 16.09.2008, this Court passed an interim order in W.P.M.P.No.36173 of 2007, which reads as follows: "There shall be interim direction to the respondents to consider payment of minimum scale applicable to the post of Grade-II Driver to the petitioner and pass appropriate orders as per law within a period of six weeks from the date of receipt of a copy of this order and communicate the same to the petitioner."

When the matter is taken up for consideration, learned Standing Counsel for the respondent Corporation has submitted proceedings, dated 20.10.2008, issued by the Regional Manager, Mahabubnagar, Andhra Pradesh State Road Transport Corporation stating that in pursuance of the orders of this Court in W.P.M.P.No.36173 of 2007 on 16.09.2008, the respondent Corporation has considered the case of the petitioner and hence, the writ petition has become infructuous.

Recording the same, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ RAJA ELANGO, J Date: 14th October, 2016 KL
