THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.26971 of 2001 ORDER:
Today, when the matter is taken up for hearing, it is informed by the counsel for the petitioner that under the A.P. Shops and Establishments Act, 1988 (for short 'the Act') order has been passed by the 1st appellate authority reinstating the petitioner into service. Thereafter, the employer approached the 2nd appellate authority under the Act, wherein the 2nd appellate authority has remanded the matter to the original authority by setting aside the order of 1st appellate authority.
In view of the fact that petitioner has already been reinstated into service in pursuance to the order passed by the 1st appellate authority, the employer filing Second Appeal under Act has no consequence and significance, hence the employer shall not press for the orders to be passed by the 2nd appellate authority.
In view of the facts and circumstances of the case, the orders passed by the 2nd appellate authority is set aside and the petitioner, if he is reinstated into service in pursuance to the orders passed by the 1st appellate authority, shall be allowed to continue in service.
With the above observation, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
