.I and Crl.P.No.204 of 2018 COMMON ORDER The criminal petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in Cr.No.1188 of 2017 on the file of Banjara Hills Police Station, Hyderabad District, registered for the offences under Sections 420, 406, 468, 471 IPC, against the petitioner/accused.

I.A.No.2 of 2019 is filed under Section 320(2) of Cr.P.C., by both parties seeking leave of this Court to compound the offences and to record compromise as the matter was settled out of the Court. Along with the affidavits, they filed a joint memo of compromise stating that the 2nd respondent lodged a complaint against the petitioner alleging that the petitioner was falsely claiming as power of attorney holder of the original owner, by name Dr. Mohammed Mohiuddin, and based on the same, aforesaid crime was registered against him. It is stated that the accused realized that the persons, who executed the GPA document, had misrepresented him that they are the true owners of the subject property even though they were not and that the de-facto complainant having understood that the accused might have acted under the said mistake, but not with criminal intention, and therefore, he intends to withdraw the present complaint.

Today, when the matter came up for hearing, the Special Power of Attorney Holder Dr. Mohammed Mohiuddin, represented by his agent2nd respondent/de-facto complainant and the petitioner/accused are present and they are identified by their respective counsel. They filed xerox copies of their aadhar cards along with the affidavits. When this Court enquired the parties, the de-facto complainant and the accused stated that they entered into compromise due to intervention of the elders.

4. In view of the settlement arrived at between the parties, I find that it is a fit case to record compromise between parties and to quash the proceedings against the petitioner/accused.

5. In the result, I.A.No.2 of 2019 is ordered. Consequently, the Criminal Petition is allowed and the proceedings in Cr.No.1188 of 2017 on the file of Banjara Hills Police Station, Hyderabad District, are hereby quashed against the petitioner/accused.

6. Miscellaneous petitions, if any pending in the criminal petition, shall stand closed.
