HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.327 of 2022 O R D E R:
This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused No.1 seeking bail in the event of his arrest in connection with Crime No.286 of 2021 on the file of Nalgonda Rural Police Station, Nalgonda District, registered for the offence punishable under Section 306 read with Section 34 IPC.

The case of prosecution is that the petitioner/A1 has defamed the husband of de-facto complainant that he was burnt the haystack and also picked up a quarrel with her husband and in the panchayath held by the villagers, a sum of Rs.10,000/- was collected from her husband as compensation, due to which her husband felt insulted and committed suicide by consuming poison on 14.11.2021 and died in the hospital on 19.11.2021 while undergoing treatment.

Learned counsel for petitioner Sri S. Ravi Kumar, submits that absolutely there are no allegations against the petitioner that he has instigated or abetted the deceased to commit suicide. Learned counsel submits that the petitioner is an agriculturist and he never quarrelled with the deceased and as none of the allegations attracts the offence under Section 306 IPC, his case may be considered for grant of pre-arrest bail. 4.
On the other hand, learned Assistant Public Prosecutor submits that the investigation is pending and so far, 5 witnesses were examined, and in view of the allegations in the complaint, petitioner is not entitled for pre-arrest bail.

Taking into consideration the allegations in the complaint, it appears prima facie that there is no instigation or abetment by the
petitioner to commit suicide by the deceased, this Court deems it appropriate to grant pre-arrest bail to petitioner/A1. 6.
The Criminal Petition is allowed. Petitioner - Accused No.1 shall surrender before the Station House Officer, Nalgonda Rural Police Station, Nalgonda District, in connection with Crime No.286 of 2021 within one week from today and on such surrender and executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, he shall be released on bail. It is made clear that no further extension of time will be granted.
