CRIMINAL PETITION NO. 301 OF 2018 O R D E R :
This Criminal Petition is filed by the petitioners under section 438 of Cr.P.C., seeking grant of bail to the petitioner, who are A-12 to A-30 in Crime No. 433 of 2017 of Chevella Police Station, Ranga Reddy district, registered for the offences punishable under section 143, 147, 436, 448, 427, 341, 452, 506, 120 [b] read with section 149 of I.P.C.
2. Heard the counsel for the petitioners and the learned Additional Public Prosecutor representing the respondent/State.
3. The allegation against these petitioners is that they formed into unlawful assembly, with a common intention to set fire to Kohinoor Rubber Factory and all the petitioners entered into the said factory and set fire to the rubber factory.
4. The counsel for the petitioners submits that the other accused were enlarged on bail and that these petitioners stand on the same footing.
5. Considering the facts and circumstances and nature of allegations, this Court opines that it is not a fit case for grant of anticipatory bail to the petitioners. However, the petitioners can surrender before the court concerned and seek regular bail. On such surrender, the concerned court is directed to consider the bail application of the petitioners on merits and in accordance with law, on the same day subject to the regular pressure of work.
6. With the above observation, this Criminal Petition is dismissed.
7. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
