HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 21437 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.

In the instant writ petition, the petitioner challenges the revision of property tax made by respondent No.2.

Mr.K.R.Koteswara Rao, learned counsel appearing for respondent No.2, at the outset, invited our attention to Section 93 of the Cantonments Act, 2006 and submitted that the order/demand, impugned in the present writ petition, is appealable under this provision.

Having confronted with this, learned counsel for the petitioner prays for withdrawal of the writ petition with liberty to the petitioner to file appeal. He submits that if the petitioner files appeal within a period of two weeks from today, the appellate authority may be directed to consider the same without raising objection as to the limitation. Writ petition is disposed of as withdrawn with liberty as prayed. If the petitioner files appeal within a period of two weeks from today, the appellate authority shall consider the same on merits in accordance with law without entering into an issue of limitation.

Consequently, miscellaneous petitions, if any, also stand disposed of.
