State Of Ap v. B R Sridevi
THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.S.K. JAISWAL Writ Appeal No.120 of 2018 Judgment: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} Sri M. Balaji, learned counsel for the respondent-writ petitioner, would submit that the subject matter of the Writ Petition is covered by an order of this Court in State of Andhra Pradesh vs. Smt. P. Usha Rani1 wherein an earlier Division Bench judgment of this Court in SubRegistrar, Srikalahasti vs. K. Guravaiah2 was followed. Learned Government Pleader for Revenue (Assignment), on the other hand, would submit that, while the subject matter of the Writ Petition is no doubt covered by the order of the Division Bench of this Court in Smt. P. Usha Rani1, the appellants herein intend carrying the said order in appeal to the Supreme Court.
As the law declared by coordinate benches, in the aforesaid two judgments, is binding on us, we see no reason to take a different view and interfere with the order under appeal.
The Writ Appeal fails and is, accordingly, dismissed.
Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
