HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1062 OF 2020 ORDER:

Heard Sri K.Sunil Goud, learned counsel for the petitioners and the learned Government Pleader for Irrigation. This writ petition is filed seeking the following relief :- "...............writ of mandamus more particularly one in nature of direction to the respondent not to indulge in illegal activities under the influence of Psuedo politician trying to encroach our land of common property by attempting on 09.01.2020 and 10.01.2020 to remove the fencing, tress and plants on the northern side of our property i.e., 10 X 97 feet 108 sq.yards from West end to East end of our common property, which are echo friendly, i.e House No.4129/2, 4-129 and 4-129/1-2 situated in Survey No.415 at Janmabhoomi Nagar, Macherial Municipal and District and pass such other............" It has been contended by the petitioners that they own the properties in Sy.

No.415, Janmabhoomi Nagar, Macherial Municipality and District and the respondents are trying to dispossess them without following due process of law. Therefore, learned counsel for the petitioners contends that appropriate orders be passed in the writ petition directing the respondents not to dispossess the petitioners without following due process of law.

Learned Standing counsel appearing for the respondents had contended that respondents would interfere with the possession of the petitioners only after following due process of law.

This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to follow the due process of law before initiating any action against the petitioners.

With the above direction, this writ petition is disposed of. No order as to costs.
