THE HON'BLE SRI JUSTICE K.C.BHANU CIVIL REVISION PETITION NO.619 OF 2015 ORDER:

This petition is filed aggrieved by the auction notice, dated 13-1-2015 served on the petitioner, dated 08-02-2015 fixing the auction date on 26-02-2015 for sale of immovable properties mentioned in E.P.No.75 of 2013 in O.S.No.151 of 2011 on the file of the Principal Senior Civil Judge, Narasaraopet, Guntur District. 2.

Learned counsel appearing for the petitioner-J.Dr. submits that the J.Dr is ready and willing to pay the entire amount, if reasonable time is granted.

The date of auction is 26-02-2015. The petitioner appears to be a bona fide debtor. Therefore, one opportunity can be given to the petitioner so as to enable him to pay the entire due amount under the decree together with interest and costs.

4. Therefore, the petitioner herein-J.Dr is directed to pay the entire decretal amount together with interest and costs within a period of two (2) months from today. However, sale shall go on, which is scheduled to be held on 26-02-2015, but sale shall not be confirmed for 2 months. If the petitioner fails to pay the amount within the above stipulated time as directed, the Executing Court shall confirm the sale and issue sale certificate in favour of the auction purchaser. 5.

Since no adverse order is passed against the respondent herein, notice to the respondent in this revision is not necessary.

6. Accordingly, the Civil Revision Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this revision shall stand closed.
