HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CRIMINAL PETITION NO. 835 OF 2015 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C to quash the proceedings in D.V.C.No. 30 of 2014 on the file of I Additional Chief Metropolitan Magistrate at Visakhapatnam.

2. After arguing for some time, counsel for the petitioners seeks to withdraw this Criminal Petition with liberty to contest the DVC on merits.

Accordingly, the Criminal Petition is dismissed as withdrawn granting liberty to the petitioners to contest the DVC on merits. It is also open to the petitioners to move the learned Magistrate for dispensing with the appearance of the petitioners by showing sufficient cause and if such an application is filed, the learned Magistrate shall consider the same in accordance with law.

4. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
