ORDER

Heard learned counsel for the petitioners, learned Government Pleader for Fisheries for respondent Nos.1,2,4 and 5, learned Government Pleader for Revenue for respondent No.3 and learned Government Pleader for Home for respondent No.6. 2.

This writ petition is filed seeking a writ of mandamus to declare the action of respondents 4 and 5 in not collecting lease amount and not issuing fishing orders to the petitioner Society for the year 2018-19, as illegal and arbitrary.

The petitioner asserts that the petitioner society is entitled to carry on fishing operations in Uracheruvu tank, Kalakova Village, Munagala Mandal, Suryapet District, for the year 2018-19. 4.

Learned counsel for the petitioner submits that though the lease amount was collected from the petitioner society on 14.02.2019, necessary order has not been passed by the respondents.

When the matter came up for admission on 24.01.2019, at request of the learned Government Pleader to get instructions, the matter was adjourned to 14.02.2019. Though more than four weeks have elapsed, learned Government Pleader submits that no instructions have been received from the authorities concerned.

Having regard to the facts and circumstances, without expressing any opinion with respect to the fishing right of the petitioner society and the alleged acceptance of the lease amount by the respondents, the Writ Petition is disposed of, directing the 2nd respondent to examine the claim of the petitioner and issue necessary instructions to his subordinates to take appropriate action within a period of one week from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
