HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.1252 OF 2019 ORDER:
When the matter is taken up for hearing, the learned counsel for the petitioner submitted that the petitioner had participated in the selection process for the post of Medical Lab Technician and she is fully eligible and qualified to be appointed as Medical Lab Technician, but the respondents are not considering the case of the petitioner on the ground that the qualifications prescribed for the said post is B.Sc. MLT, whereas the petitioner possesses the qualification of Intermediate in Medical Lab Technician (MLT) and the said qualification possessed by the petitioner was not stated in the notification issued by the respondents, but subsequently it was clarified vide G.O.Ms.No.88, dated 15.02.2018, that Intermediate with MLT is also equivalent qualification for the post of Medical Lab Technician.
Learned counsel further submits that the petitioner has participated in the selection process in pursuance of the notification issued by the respondents and she stood first in the entire merit list and contends that appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for appointment to the post of Medical Lab Technician. Smt.
would be considered in terms of G.O.Ms.No.88, dated 15.02.2018, and appropriate orders would be passed.
In view of the rival submissions of the learned counsel for the respective parties, this Court is of the considered view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for appointment to the post of Medical Lab Technician strictly in terms of G.O.Ms.No.88, dated 15.02.2018, and pass appropriate orders in accordance with law. With the above observations, the writ petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
