This petition is filed, by the petitioner, who is A2, seeking for quash of the proceedings in C.C.No.88 of 2013 on the file of XII Additional Chief Metropolitan Magistrate, Hyderabad.

The offences alleged are under Sections 365, 384 and 507 r/ w 511 IPC.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.

The counsel for the petitioner submits that the case against this petitioner was split up and the case against A1, A3 and A8 was tried and ended in acquittal. He also filed a copy of the judgment, dated 23.04.2013, passed in C.C.No.108 of 2011 by the Court of XII Additional Chief Metropolitan Magistrate, Hyderabad, wherein the court considering the facts of the case held that the prosecution failed to establish the charges framed against the accused.

A perusal of the complaint shows that this petitioner also stands on the same footing as that of A1, A3, and A8. 5.

With the above observations, the Criminal Petition is allowed and the proceedings against the petitioner in C.C.No.88

of 2013 on the file of XII Additional Chief Metropolitan Magistrate, Hyderabad, are hereby quashed.

As a sequel, the miscellaneous applications, if any pending, shall stand closed.
