2017-07-12S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.22921 of 2017 ORDER:

The writ prayer is one against inaction in disposing of the representation dated 12.04.2017 filed by petitioners for grant of Pattadar Passbook/ Title deed under the A.P. Rights in Land and Pattadar Passbooks Act, 1971 (for short 'the Act').

2. Learned Assistant Government Pleader objects to the maintainability of the writ petition by contending that the application filed by the petitioners do not satisfy with the requirements of the Act and the petitioners are always free to apply as prescribed under the Act and after such application is made, the respondents follow the time limit prescribed for passing the orders and the writ petition is premature.

3. Mr. M. Adam requests the court to permit the petitioners to apply as prescribed by the Act/ Rules and the Authorities may be directed to consider the application filed by the petitioners.

4. This court has no reason to doubt at this juncture that respondents, if received application as prescribed by law, will consider and dispose of the same expeditiously. Liberty as prayed for is granted and this court has no reason to doubt that the authorities will follow procedure in considering the request of the petitioners. The petitioners, if so advised, can enclose the copy of this order for timely decision.

5. The writ petition is disposed of accordingly. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
