THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.22184 of 2017 ORDER:

The petitioners pray for the following relief :- " ........ to pass an order or orders or writ particularly one in the nature of a Writ of Mandamus declaring the action of 4th respondent authorities in trying to dispossess the petitioners from her land in Sy.No.131/ 1/ 62 admeasuring to an extent of Act-24 gts, situated at Bethupally Gangaram Village, Sathupally Mandal, Khammam District, at the behest of respondent No.5 & 6 without issuing any notice and without following due process of law, as being illegal arbitrary against the principles of natural justice and violation of the Petitioner's rights guaranteed under Article 21 and 300-A of the Constitution of India and consequently, direct the Respondents No.4 not to dispossess or in any manner interfere with the peaceful possession and enjoyment of the petitioners lands ....."

The Assistant Government Pleader places on record written instructions dated 06-06-2013. The relevant portion reads thus :- " Further I submit that, in respect to the allegations made by the petitioners are totally denied and strict proof is required for it. This office or any of the official respondents mentioned in the W.P. are never entered into the petitioners scheduled property in any manner. All the allegations made by the writ petitioners are invented by them only. Threatening of the petitioner and all other allegations are false and far away from the truth. Other issues mentioned by the petitioners in their affidavit are not related to revenue officials."

Counsel for petitioners submits that the statement of Assistant Government Pleader can be placed on record and the writ petition can be disposed of.

The submission of counsel for petitioners is accepted. By placing on record the statement of Assistant Government Pleader, the writ petition is disposed of accordingly. No order as to costs.
