THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14416 of 2002 ORDER:

This writ petition is filed seeking the following relief: " to issue a writ of Mandaums or any other appropriate writ order or direction directing the respondents to consider the case of the petitioner to be appointed as Junior Linemen in accordance with the guidelines issued by the 1st respondent vide Lr.No.GM(IT)/ AS(IR)PPO.II/ A1/ 561/ 2001 dated 24.5.2002 and further declare the insistence of the service certificates to be issued by Sarpanch as illegal and arbitrary."

When the matter is taken up for hearing, it is noticed that the petitioner had attained the age of superannuation and a perusal of the record would disclose that this Court had granted interim direction to consider the case of the petitioner vide orders dated 8.8.2002. If the case of the petitioner is considered for appointment as Junior Lineman pursuant to the interim orders, his appointment shall not be disturbed and if the case of the petitioner is rejected, then this court cannot give any direction, at this stage, to consider the case of the petitioner since the petitioner had already attained the age of superannuation.

With the above observations, the Writ Petition is closed. No order as to costs.
