THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.1136 OF 2018 ORDER:
It is the case of the petitioners that they purchased two portions of land in an extent of 419 square yards each amount to a totalling an extent of 838 square yards, situated in Survey No.48/1 of Bhavanipuram, Vijayawada Municipal Corporation, Vijayawada, through separate registered sale deeds bearing document Nos.2379/2016 and 2378 of 2016, dated 04.04.2016. Their vendor purchased the said land under registered sale deed dated 18.12.1986. His vendor purchased the same under document of 1975. When some third parties tried to interfere with the said land, the petitioner's vendor filed O.S.No.328/2015 for permanent injunction on the file of III Additional Junior Civil Judge at Vijayawada and the same was decreed in favour of the vendor of the petitioner on 06.07.2015. The petitioners state that they applied for survey of the land on 10.10.
2017, as there was a dispute with the neighbour with regard to boundary between the neighbours land and the land of the petitioners. When the respondents 3 and 4 did not take any action in spite of payment of the requisite fee, pursuant to the application dated 10.10.2017, the present writ petition is filed.

Since the grievance of the petitioners is to survey the land of an extent of 838 square yards situated in Survey No.48/1 of Bhavanipuram, Vijayawada, purchased by the petitioners under the registered sale deeds dated 04.04.2016, this writ petition is disposed of, directing the respondents 3 and 4 to consider the said application and take necessary action, in accordance with law, within a period of two months from the date of receipt of copy of this order. 3.
Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
