Heard Sri B.Nalin Kumar, learned counsel for petitioner, learned Government Pleader for Revenue for Respondents 1 to 4 and Sri Vijay B.Paropkari, learned counsel for Respondent No.5. 2.

The writ petition is filed challenging the notice dated 18.1.2019 issued by the 3rd respondent-Tahsildar, proposing to conduct survey in respect of land in Survey No.16 of Aushapur village, Ghatkesar mandal, Medchal district on 24.1.2019 at 10.30 a.m. On 23.1.2019, this Court granted interim suspension of the said notice. 3.

Learned counsel appearing for Respondent No.5 submits that the cause in the writ petition does not survive since the notice specifically mentions the date of survey as 24.1.2019, a day before this Court suspended the said notice and therefore, no survey was conducted on the said date. Hence, nothing survives in the writ petition for further adjudication and learned counsel contends that he has no objection if the writ petition is allowed, setting aside the said notice.

In view of the fair submission of the learned counsel for Respondent No.5, the writ petition is allowed, setting aside the notice dated 18.1.2019 issued by the 3rd respondent.
