THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO I.A.No.1 of 2018 and WV.MP.No.3809 of 2017 in WP.MP.No.23719 of 2017 in/and W.P.NO.19468 of 2017 and C.C.No.2846 of 2017 COMMON ORDER:

I.A.No.1 of 2018 has been filed by the petitioner in the Writ Petition contending that though he has challenged Memo No.19265.Ser.I/A1/2016 dt.25.05.2017 issued by the 1st respondent relieving him as an employee of the State of Telangana on the ground that his nativity is in the State of Andhra Pradesh, he is now not pressing for the said relief and he is willing to join in the State of Andhra Pradesh. 2.

Petitioner therefore seeks a direction to respondents 1 & 3 to relieve him from the post he is holding in the State of Telangana before 30.06.2018 and to respondents 2 & 4 to permit him to joint in the State of Andhra Pradesh in the corresponding post in the said State.

Though there is an interim order on 21.06.2017 in WP.MP.No.23719 of 2017 in the Writ Petition in favour of the petitioner stating that he shall not relieved from the post where he is working, in view of the prayer made by the petitioner in I.A.No.1 of 2018 and disinclination of the petitioner to pursue the challenge to the proceedings

dt.25.05.2017, I hereby allow WV.MP.No.3809 of 2017 vacating the order dt.21.06.2017 and direct respondents 1 & 3 to relieve the petitioner from the State of Telangana; and respondents 2 & 4 to permit the petitioner to join in the State of Andhra Pradesh in the corresponding post before 30.06.2018.

Accordingly, I.A.No.1 of 2018 in WP.No.19468 of 2017 is allowed and consequently, W.P.No.19468 of is dismissed as infructuous granting liberty to the petitioner to question denial of promotion to him, if any, in the appropriate forum. No costs.

In view of the fact that the interim order dt.21.06.2017 has been vacated, the Contempt Case is closed. No costs. 6.

Consequently, miscellaneous petitions pending, if any, in both the cases shall stand dismissed.
