THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION NO.3791 OF 2012 ORDER:

This civil revision petition is filed under Article 227 of the Constitution of India challenging the order in C.M.A.No.28 of 2010 dated 20.01.2012 passed by the Principal District Judge at Vizianagaram, filed against the order and decree in I.A.No.551 of 2010 in O.S.No.245 of 2010 dated 28.09.2010 on the file of Principal junior Civil Judge, Vizianagaram.

The petitioner filed I.A.No.551 of 2010 under Order XXXIX Rule 1 and Section 151 of C.P.C for grant of interim injunction restraining the respondents/defendants from interfering with the petitioner's business during pendency of the suit. The Trial Court passed an interim order and the same was reversed by the Principal District Judge in C.M.A.No.28 of 2010.. Now, it is informed by the Principal Junior Civil Judge's Court, Vizianagaram, that O.S.No. 245 of 2010 was dismissed as not pressed on 08.10.2012. Hence, in view of the dismissal of the suit, the present civil revision petition has become infructuous. In the result, the civil revision petition is dismissed as infructuous. No costs.

Consequently, miscellaneous applications pending if any, shall also stand dismissed.
