THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.30722 OF 2016 ORDER:

The case of the petitioner is that she was initially worked as mate and thereafter, she was appointed as Rojgarsevak in the year 2010 in Bangarayyapeta village, Rowthulapudi Mandal, East Godavari District. She was placed under suspension by order, dated -09-2014 and it was served on 20-10-2014. On two charges, she submitted her explanation to the show-cause notice on 25-10-2014 and another explanation on 09-11-2015 and she denied the charges. As there was no conclusion on the enquiry, she filed W.P.No.40728 of 2015 and the same was disposed of on 16-12-2015 directing the disciplinary authority to finalise the disciplinary proceedings within a period of four weeks from the date of receipt of a copy of order.

Thereafter, when the case was not disposed of, the petitioner filed contempt case and ultimately, she was terminated from service, vide proceedings, dated 05-02-2016. In view of said order of termination, the contempt case was closed on 07-04-2016. The petitioner preferred an appeal to the 2nd respondent on 21-08-2016 and even before completion of one month, she filed the present writ petition.

In view of exercise of alternative remedy, this Court is not inclined to admit the present writ petition. But, however, the 2nd respondent is directed to consider the appeal preferred by the petitioner and pass appropriate orders thereon in accordance with law within a period of three months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
