THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.4154 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner questions the action of the Tahsildar, Visakhapatnam, the 4th respondent, in mutating the names of the third parties, who are not parties to the present Writ Petition and seeks a mandamus to restrain the Revenue Divisional Officer, Visakhapatnam, the 3rd respondent, and the 4th respondent from effecting mutation. The petitioner is stated to have filed representations before the 3rd and 4th respondents on 08.01.2016 in this regard. Since the third parties against whom the petitioner seeks mandamus are not named even in the objections and he seeks relief against some unknown persons, the present Writ Petition cannot be entertained. If the objections of the petitioner are before the 3rd and 4th respondents, it is open to them to consider the same and pass appropriate orders in accordance with law.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
