HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.1184 of 2019 ORDER:
The grievance of the petitioners is with regard to the appellate order dated 27.12.2018 passed by the Revenue Divisional Officer, Warangal, under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 (for brevity 'the Act'). The impugned order is amenable to revisional jurisdiction under Section-9 of the Act. This Court sees no reason as to why the petitioners should circumvent the statutory remedy of revision available to them and directly approach this Court by way of this Writ Petition. Needless to state, a revision would be far wider in its scope than a Writ Petition filed under Article-226 of the Constitution.
In the light of the more effective alternative remedy provided to the petitioners under the statute, this Court is not inclined to entertain this Writ Petition.
The Writ Petition is accordingly dismissed on this short ground. This order shall however not preclude the petitioners from invoking the remedy of revision available to them in accordance with law. It is made clear that this Court has not gone into the merits of the case and it would be open to the revisional authority to adjudicate any revision filed before it on its own merits and in accordance with law.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
